ARABEX Terms & Conditions

This Agreement governs the relationship and responsibilities between ARABEX Car Rental (ARABEX) and the Client (you) for the use of ARABEX luxury vehicles. By reserving or using any ARABEX vehicle, you agree to adhere to all terms outlined below.

1. Client Eligibility & Agreement

1.1 Client Declaration

By entering this agreement, you confirm that you have read, understood, and accept all commitments and obligations, including terms related to damages, liability, and indemnification.

1.2 Eligibility Requirements

  • Age: You must be 21 years or older.
  • License: You must hold a valid UAE driving license or an approved foreign license (e.g., GCC, UK, US, EU, Australia, etc.) that complies with current UAE laws.
  • Validity: You must maintain a license that is valid and in good standing throughout the rental period.
  • Right to Refuse: ARABEX reserves the right to request additional information or reject an application at its sole discretion.

1.3 Loss of Eligibility

You must immediately notify ARABEX if your driving license is suspended, revoked, or if you incur serious driving offenses (e.g., DUI, reckless driving). Failure to report such changes may void your insurance coverage and lead to immediate termination of the agreement.

2. Vehicle Use & Trip Management

2.1 Vehicle Inspection

Before taking possession of the vehicle, you must inspect the interior and exterior for any existing damage or excessive soiling. Any visible issues must be reported to ARABEX Customer Service immediately. Failure to report damage prior to use may result in you being held responsible for the repair costs.

2.2 Area of Operation (Mileage)

  • Geographic Limits: ARABEX vehicles are permitted for use within the UAE only. Driving the vehicle outside the UAE is strictly prohibited and will result in penalties and full liability for recovery costs.
  • Mileage Limit: All rentals include a standard daily mileage limit (e.g., 250 km/day). Exceeding this limit will incur an excess mileage fee as detailed in the Fees Schedule.

2.3 Prohibited Use

The vehicle must not be used for illegal activities, off-roading, racing, towing, or carrying passengers/goods for hire (unless authorized). Only the client who signed the agreement is authorized to drive the vehicle.

3. Fines, Damages, and Liability

3.1 Traffic Violations & Salik (Tolls)

You are solely responsible for all traffic fines, black points, and Salik charges (tolls) incurred from the moment you take possession of the vehicle until the time it is returned. You consent to the transfer of all such fines and black points to your account, and ARABEX will process these fines with an additional administrative fee as per the Fees Schedule.

3.2 Damages & Insurance (FDC)

  • Client Liability: You are responsible for all damages incurred to the ARABEX vehicle or third-party property during the rental period.
  • Full Damage Coverage (FDC): If FDC is purchased, your financial responsibility for insured damages is limited to the deductible amount specified in your agreement.
  • FDC Exclusions: FDC does not cover damages resulting from negligence, willful misconduct, driving under the influence (DUI), or use by an unauthorized driver. In these cases, you are responsible for the full cost of all damages and third-party liabilities.
  • Accident Procedure: In case of an accident, you must immediately notify ARABEX and provide a valid police report. Failure to comply may void insurance benefits.

3.3 Security Deposit

A mandatory security deposit will be held on your credit card. This deposit covers potential traffic fines, Salik, and minor damages. The deposit is typically refunded 15–30 days after the vehicle is returned, allowing time for fine verification by RTA/Police authorities.

4. Fees, Payments, and Termination

4.1 Payments and Invoicing

Rental Fees are payable in full upon reservation or as scheduled in your long-term agreement. ARABEX is authorized to charge the payment method provided for all rental fees, fines, penalties, and Salik charges.

4.2 Termination by Client

You may terminate the agreement early by written notice and payment of all outstanding fees. Penalties for early termination of long-term rentals will apply as per the Fees Schedule (e.g., 1-2 month penalty based on contract duration).

4.3 Termination by ARABEX

ARABEX may terminate this Agreement and repossess the vehicle immediately if you fail to pay fees, violate the terms of use, lose eligibility, or misuse the vehicle. You will be responsible for all associated costs, including recovery and outstanding fees.

4.4 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.
